1. INTRODUCTION
These Terms & Conditions (“Terms”) govern the access, browsing, and use of this website and all online platforms, forms, communication channels, and digital services operated by Visaminds Consulting (PVT) Ltd, a company incorporated under the laws of Sri Lanka, having its registered office at No. 419/A, Nawala Road, Nawala, Sri Lanka (“Company”, “we”, “us”, “our”).
By accessing this website, submitting an inquiry, making a payment, or using any of our services, you confirm that you have read, understood, and agreed to be bound by these Terms.
2. NATURE OF SERVICES
2.1 The Company provides visa consultation and advisory services only.
2.2 The Company is not an embassy, consulate, immigration authority, or government agency and does not issue visas or influence visa decisions.
2.3 All visa approvals, refusals, delays, conditions, and timelines are at the sole discretion of the relevant immigration authorities.
3. NO GUARANTEE & DISCLAIMER
3.1 The Company makes no representation, warranty, or guarantee of visa approval, processing timelines, or outcomes.
3.2 Visa refusal, rejection, delay, administrative processing, or policy changes shall not be considered a failure of service.
3.3 The Company shall not be responsible for losses arising from decisions made by immigration authorities.
4. FEES, INVOICES & REFUNDS
4.1 Fees charged by the Company relate strictly to professional consultation services.
4.2 Invoices are issued separately and form an integral and legally binding part of the contractual relationship.
4.3 Refund terms stated on the invoice shall be final, conclusive, and overriding, irrespective of any general language on the website.
4.4 No refunds shall be granted for visa refusals, delays, withdrawal by the client, submission of false or incomplete documents, or changes in immigration law.
5. COMMUNICATION, TIMELINES & NOTICES
5.1 All timelines, service milestones, and deadlines shall be communicated via email.
5.2 Any changes to timelines shall be notified via email and shall be binding upon the client.
5.3 Email communication shall be deemed valid legal notice.
6. CLIENT CONDUCT & OBLIGATIONS
Clients must provide accurate, complete, and genuine information and documents within the timelines communicated by the Company.
7. ONLINE & OFFLINE REVIEWS / DEFAMATION
7.1 Clients shall not publish or disseminate any false, misleading, defamatory, or damaging statements or reviews about the Company.
7.2 Negative reviews may only be published where supported by a final court judgment in Sri Lanka establishing a breach by the Company.
7.3 The Company reserves the right to seek damages, injunctions, and legal costs for reputational harm.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company’s total liability shall be limited to the consultation fee paid as per invoice.
9. GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of Sri Lanka. Courts of Sri Lanka shall have exclusive jurisdiction.
10. AMENDMENTS
The Company may amend these Terms at any time. Continued use constitutes acceptance.
